APP DRIVER AGREEMENT 

APP Driver Agreement 

This Lynkup Taxi Service Inc. Driver Agreement  is herein made between you and Lynkup Taxi Service Inc. These agreements are applicable conditions to your provision of Services through the Lynkup Taxi Service’s Platform. 

Driver Fare. As a Driver, you will be paid for each ride you provide to the Riders. Your fare as a Driver for a completed ride consists of a base fare amount plus waiting time, travel time, and the actual distance of the ride, as measured by Lynkup Taxi Service Inc.’ technology. Each completed trip will be displayed on the driver dashboard. Passengers will not be able to see what your earnings are as these are personal. Some Drivers will have a predetermined rate (such as a flat rate or contracted trip). In situations where a Rider cancels your ride in violation of Lynkup Taxi Service’ cancellation policy, Lynkup Taxi Service Inc. may charge the Rider a cancellation fee on your behalf. Lynkup Taxi Service Inc. makes no guarantee, representation or warranties concerning the amount of earning that each Driver will receive on a daily or weekly basis. Your earnings are subject to change in Lynkup Taxi Service Inc.’ discretion and any such changes shall be published on the website and or on your Driver dashboard. By continuing to use the Lynkup Taxi Service Platform, you are hereby agreeing to the following: 

Additional Payments to You. In addition to the Driver Fare, the following payments will be made available to you, if applicable: (i) any and all tips provided by a Rider to you, (ii) any and all tolls or surcharges we collect for remittance to you, (iii) any damage charges that we may collect on your behalf, (iv) any bonuses or incentives you earn based on your provision of Services, and (v) any other payments or cash incentives we choose to award you based on our predetermined evaluation of your services. 

Payments, Adjustments and Settlement. Lynkup Taxi Service Inc. will collect all payments owed to you by Riders through our payment gateways provided by their parties and you agree that the receipt of such payments by Lynkup Taxi Service Inc. satisfies the payer's obligation to you. Lynkup Taxi Service Inc. reserves the right to adjust or withhold all or a portion of Fare or any other such payment owed to you (except tips)based on the following; (i) if we reasonably believe that you have attempted to defraud or abuse Riders, Lynkup Taxi Service Inc. or Lynkup Taxi Service Inc.’ payment systems, or (ii) You deliberately took an inefficient route or failed to properly end a trip in the Lynkup Taxi Service Inc. application when the ride was over. Lynkup Taxi Service Inc. will endeavor to be fair in its operations and decisions at all times. We will use reasonable efforts to ensure that your Driver Fare and any other payments to you will be paid to you on a weekly basis. You acknowledge and agree that all payments owed to you shall not include any interest and will be net of any amounts that we are legally required and or allowed to withhold. 

Rider Fare Charges. Lynkup Taxi Service Inc. will charge the Rider an amount calculated or determined by Lynkup Taxi Service Inc. application on your behalf of Services you perform for Riders. Fares shown to Riders at the time of booking, are mostly estimates, as other variables during travel, may alter said quoted fare. Riders may so elect to add an additional tip to you on top of the Rider Charges. The tip shall be paid entirely to you and shall be considered separate from the Rider Charges. 

Our Service Fees.  Lynkup Taxi Service Inc. provides a Platform and other services to you in order to operate as a part of the company. In exchange for your use of the our Services, you agree to pay Lynkup Taxi Service Inc. (and or permit Lynkup Taxi Service Inc. to retain) a service fee, which is based on each ride you provide. The Service Fee is a set amount for each ride. The Platform Fee shall be a variable amount equaling the Rider Charges minus: (i) the Driver Fare, (ii) any tolls or surcharges we collect for remittance to you, (iii) the Service Fee, (iv) any Third Party Fees that Lynkup Taxi Service Inc. collects, and (v) any bonuses or incentives you earn based on your provision of Services. 

Payment Processing. Our payment service is provided by Stripe and is subject to the Stripe Connected Account Agreement, which is available at https://stripe.com/us/connect-account/legal). This also includes the Stripe Services Agreement (available at https://stripe.com/us/legal).  Your use of the Lynkup Taxi Service Inc. Platform to receive payment proceeds, is an affirmation of your agreement to be bound by the Stripe Terms, and we are not responsible for any present or future modification that Stripe may make periodically.  As a condition of the use of Stripe payment gateway and your use of Lynkup Taxi Service Inc., you authorize Lynkup Taxi Service Inc. to obtain all necessary access and perform all necessary activity on your Stripe Connected Account to facilitate your provision of Services as contemplated by the Agreement and your relationship with Lynkup Taxi Service Inc.. In order to accurately process your payments for the use of our services, you agree to provide accurate and complete information about you and your business and authorize Lynkup Taxi Service Inc. to share it and transaction information with our payment gateway, Stripe for the purposes of facilitating of the payment processing services they provide. Lynkup Taxi Service Inc. reserves the right to change payment processing vendors, add payment vendors, or use alternate or backup vendors in its discretion. 

Promotions and Coupons. Lynkup Taxi Service Inc. may, at its discretion or frequency, offer promotional or other Coupons to Riders, or provide discount rides based on quantities or other factors as Lynkup Taxi Service Inc.’ management authorize. Any such discount, promotions, etc., shall not be deducted from the driver’s income. Lynkup Taxi Service Inc. may choose to sell passes or subscriptions on your behalf in order to generate additional leads for your Services, thus increasing your income potential. 

Payment Days and Terms. Lynkup Taxi Service Inc. agrees to make payments to all drivers weekly on Tuesdays. All rides given will be calculated from Mondays to Sundays and will be deposited to the account you provided, and we have on file.  You are expected to submit your banking information (name on account, account number, bank name, & routing number) upon signup or emailed to Lynkuptaxi@gmail.com immediately after signup and or Driver approval process is completed. 

NOTE: Downloading, installing and online setup of our app is an acceptance of the above terms of service. All drivers are expected to abide by all service terms. 

 

GUIDELINES FOR THIRD PARTIES

 

Lynkup taxi Services Guidelines for Third Party Data Requests  

The following guidelines are set forth with the intention to inform and educate all parties; including but not limited to civil litigants and criminal defendants, about the legal process for seeking to obtain records from Lynkup Taxi Services. Lynkup taxi Services wishes to inform all participants and requestors that these are merely dynamic guidelines, and , the organization reserves the right to modify this information at any time at the discretion of its management. 

Who are we 

Lynkup Taxi Services is an innovative and technology driven company operating with a proprietary technology application software (the “App”) that provides on-demand lead generation and related services. Through this App independent providers of transportation services respond and comply with the requests from riders requesting transportation services, . These drivers provide transportation services to riders based on their requests, picking them up and dropping them off at the venues said riders entered through their rider apps. 

Where does Lynkup taxi Services accept service of legal documents? 

According to the company’s policy, all legal documents (including complaints and subpoenas) be served on our registered agent for any such service or legal processes. 

Please ensure that all documents matches the registered entity with the Secretary of State (e.g., Lynkup taxi Services, Inc.” or “Lynkup, LLC”), Furthermore, our acceptance of any or all legal process does not waive any legal objections or questions we may have and may raise in response. 

What legal process does Lynkup taxi Services require before producing data to private parties? 

U.S. Requests 

We generally require a valid subpoena issued in accordance with applicable law before we can process private requests for information. We require non-law enforcement subpoenas to be served through our registered agent for service of process. The name and current contact information for the registered agent in each state are available online here

Our registered agent will accept service only if the entity to whom the request is directed matches the name of the entity registered with the Secretary of State (e.g., “Lynkup taxi Services Technologies, Inc.” or “Lynkup Taxi, LLC”), and our agent is authorized to accept service on behalf of that entity. Our acceptance of legal process does not waive any legal objections we may have and or may raise in response. 

What form of requests does Lynkup taxi Services require, and how are requests processed? 

We review each subpoena or data request for facial and substantive validity, and will reject requests that are not facially and substantively valid. Among other things, we require requests to be narrowly tailored, and will reject overly broad, vague, or unduly burdensome requests. Before making a request, please check to see if the information sought is publicly available. 

When making a request, we request that you supply the following: 

  • A reasonably and adequately defined time period, and the specific data requested within that time period 
  • A clear and detailed identifying ng reference (i.e., you must uniquely identify a user or driver/partner, ideally by more than just a name) 
  • Your contact information (i.e., name and email address and/or phone number) 

If in the process, it is determined that Lynkup Taxi Services is required by law to disclose data, we will search for and disclose data that we are reasonably able to locate and retrieve. 

Ity is not our policy nor intent to respond to emergency requests received from non-law enforcement officials. Non-law enforcement officials aware of an emergency situation should immediately and directly contact local law enforcement. 

COMMUNITY GUIDELINES

 

LYNKUP TAXI SERVICES COMMUNITY GUIDELINES 

We want Lynkup Taxi Services to be enjoyable and safe for everyone. These basic guidelines designed to ensure that both riders and drivers have the best experience when using Lynkup Taxi Services. Please take a few moments to read and become familiar with them. The truth is that, everyone’s behavior matters; no matter who are you and you can contribute significantly to the overall driving experience.  

Be courteous and respectful to each other 

Treat your fellow riders and drivers as you would like to be treated yourself: with respect. Always try to be on time for your ride, because nobody likes to wait; especially unnecessarily. Please refrain from shouting, swearing or slamming the car door(s), and remember to tidy up after yourself. It’s not fair for the driver to be cleaning up after you.  Think about the next rider after you so that he or she can have a clean and pleasant vehicle to ride in. Please keep in mind that, when you use Lynkup Taxi Services you will meet people who may look different, talk different, or think differently from you. Please respect those differences. We want everyone to feel welcome when they use Lynkup Taxi Services. 

Personal space 

No one likes his or her privacy to be invaded. It’s fine that you are friendly, but please don’t comment on someone’s appearance or ask whether they are single, married, or dating. As a passenger, if you need to make a phone call, keep your voice down to avoid disturbing your driver or other riders. And don’t touch or flirt with other people in the car. Lynkup Taxi Services has a no sex rule. That’s no sexual conduct between drivers and riders, no matter what, regardless of who initiates it. 

Safety first 

We are in the business of transporting from one location to another destination. We want you to get to your destination safely and therefore, we also want our drivers to adhere to the local law. Whether you’re in the front or the back seat; put your seatbelt on when you get into the car. Please leave your firearms and other weapons at home. Driver are expected to keep within the speed limit; not texting while driving; not making or taking phone calls; always using a phone mount; and never driving under the influence of alcohol or drugs. And if you’re driving and feel tired, take a break. 

Children supervision 

Only adults can have a Lynkup Taxi Services rider account. A parent or guardian must be with your child if they are using your account.  

Feedback  

We encourage both our riders and drivers to rate their journey at the end of the journey. We encourage you to submit your honest feedback which helps to ensure that everyone is held accountable for their behavior. We are trying to build and sustain a respectful, enjoyable and safe environment for both riders and drivers. 

The following guidelines help to explain some of the specific kinds of behavior that may cause you to lose access to Lynkup Taxi Services as a rider or driver.  
 
 

WHY RIDERS CAN LOSE ACCESS TO LYNKUP TAXI SERVICES 

Please remember that if you’re traveling in a group, or you allow other people to take trips with your account, you are responsible for their behavior in the car. 

Ensuring a respectful, safe environment for all drivers and riders 

Your behavior while using Lynkup Taxi Services can have a big impact on the safety and comfort of drivers, as well as your fellow passengers. Always be courteous and respectful. You are expected to exercise good judgment and behave decently towards other people both within and outside of the car when riding with Lynkup Taxi Services. 

Here are some reasons why you could lose access to Lynkup Taxi Services as a rider: 

  • Damaging drivers’ or other passengers’ property. Damaging the vehicle, scratching, breaking or vandalizing a phone, intentionally spilling food or drink, smoking, or vomiting due to excessive alcohol consumption. 
  • Physical contact with the driver or fellow riders. As our community guidelines make clear, you shouldn’t touch or flirt with other people in the car. As a reminder, Lynkup Taxi Services has a no sex rule. We have a no sexual conduct with drivers or fellow riders. We do not tolerate hitting, fighting, or any other behavior that would otherwise hurt a driver or fellow passenger. 
  • Use of inappropriate and abusive language or gestures. Asking overly personal or private questions, using verbal threats, and making comments or gestures that are aggressive, sexual, discriminatory, or disrespectful. 
  • Unwanted contact with the driver or fellow passenger after the trip is over. For example, texting, calling, or visiting someone in person after a ride has been completed. number stays anonymous and is never given to the driver. 
  • Breaking the local law while using Lynkup Taxi Services. We do not allow or support any rider bringing open containers of alcohol or drugs into the car; traveling in large groups that exceed the number of seat belts in the car; asking drivers to break local traffic laws such as speed limits; or using Lynkup Taxi Services to commit a crime, including drug and human trafficking or the sexual exploitation of children. We expect that our drivers will keep the laws at all times; especially while using our app. 

Should any driver or rider become aware of these rules being broke, kindly contact us and email the matter immediately. We will investigate expeditiously and will respond appropriately. Your account may put a hold during our investigation. Depending on the outcome of the investigation, you may lose access to Lynkup Taxi Services. Any behavior involving violence, sexual misconduct, harassment, discrimination, or illegal activity while using Lynkup Taxi Services can result in the immediate loss of access to your account. Should it become necessary for law enforcement to become involved, we will cooperate with their investigation in accordance with our Law Enforcement Guidelines. 

Discrimination 

Lynkup Taxi Services has a zero tolerance policy towards discrimination of any kind. This means you will lose access to your account if you are found to have discriminated against drivers or other riders based on their race, color, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under applicable law. 

Driver Account Deactivation 

A driver’s account can be temporarily or permanently be blocked or deactivated based on the nature of breach he or she has committed; reported and subsequently investigated. If an investigation against a driver proves that the driver has committed foul play, the nature of the act will determine the actions necessary 

There will always be unforeseen events that may ultimately lead to you losing access to your driver account — and we’ll update this policy regularly — but the following are sufficient cause for Lynkup Taxi Services to take action: quality; safety; fraud; and discrimination. 

Quality 

Riders who use Lynkup Taxi Services expect their drivers to drive safe, and also to be courteous and professional. The higher the quality of the service, the more trips riders take the more opportunities for drivers to earn money. When riders perceive that they have received poor services, they will give a poor rating.  

Star Ratings 

Drivers are expected to keep their average rating high by providing good service on every trip. We are cognizant that some trips will not go as well as you hoped or anticipated. Be courteous and respectful to all; no matter what! Sometimes a trip doesn’t go well even though we are hoping that they will all be good for both riders and drivers. If a trip’s rating is bad, don’t panic. Try to be better for the next ones.  

after multiple notifications, you will lose access to your account. If your ratings continue to fall. Especially as a driver, we will alert you to this and expect improvements. We may refer you to do improvement courses in customer services or other related studies.  

Trip Acceptance 

We are a service entity and riders are expecting consistency. Our job is to continuously prove to our riders that we are professional, and reliable. when we consistently accept trips, we are maximizing our earnings as drivers while f we consistently decline trips, while keeping the system running smoothly and effectively. We are aware that sometimes things come up that prevent you from accepting every trip request, or you may want to take a break. However, not accepting trip requests causes undue delays and degrades the reliability of the system. If you are tired, busy or simply want a break, just log off. 

Safety 

Lynkup Taxi Services is committed to your safety, both as drivers and riders. We use technology to keep drivers and riders safe and to take you to your destinations with minimal delays and danger.  

As a part of our safety measures, please adhere to the following: 

  • Use appropriate language or gestures. Refrain from asking overly personal questions, using verbal threats, and making comments or gestures that are aggressive, sexual, discriminatory, or disrespectful.  
  • Keep it professional even after the trip. Don’t be trying to start a relationship with the driver or riders after the trip is over. Don’t be, texting, calling, or visiting someone in person after a ride has been completed. 
  • Abide by the local law while using Lynkup Taxi Services. Drivers are expected to stay within the ambits of the law. No texting while driving; speeding or otherwise breaking local traffic laws; and using Lynkup Taxi Services to commit a crime, including drug and human trafficking or the sexual exploitation of children. It is unacceptable for our riders to engage in any of the above. We will assist you in breaking the laws. 
  • Safe Driving. Lynkup Taxi Services expects all our drivers using the app to drive safely at all times. 

Zero Tolerance for Drugs and Alcohol 

Lynkup Taxi Services does not tolerate the use of drugs or alcohol by drivers or riders while driving or using our app. Any driver or rider who is found to be under the influence of drugs or alcohol while using the Lynkup Taxi Services app will be permanently deactivated. Lynkup Taxi Services may also temporarily deactivate the account of any driver who receives several unconfirmed complaints of drug or alcohol use, until an investigation is done. 

Compliance with the Law 

We expect drivers using the Lynkup Taxi Services app to act in compliance with all relevant state, federal and local laws and the rules of the road always; without exceptions. Lynkup Taxi Services may permanently deactivate your account for activities such as: engaging in serious illegal activity while using the Lynkup Taxi Services app; not maintaining valid vehicle registration or driver’s license; and receiving serious traffic citations, or several traffic citations that indicate unsafe driving, while using the Lynkup Taxi Services app. 

Firearms Ban 

Lynkup Taxi Services prohibits riders and drivers from carrying firearms in a vehicle while using our app. Riders and drivers who are in violation of Lynkup Taxi Services’ firearms prohibition policy, you may lose access to the usage of Lynkup Taxi Services’ app. 

Background Checks 

All drivers wanting to use the Lynkup Taxi Services app are required to undergo a screening process, like motor vehicle record and background checks, to ensure safety and compliance with our criteria for employment. If in the process of conducting a background check we uncover a violation of Lynkup Taxi Services’ safety standards or of other criteria required by local regulators, you may lose the usage of the app. 

Fraud discovery 

As a rider or driver, you trust us, that’s one of the reason why you chose us to be your transportation partner. Fraudulent activity undermines the trust on which Lynkup Taxi Services is built. That’s why we are constantly on the lookout for fraud by riders and drivers who are trying to game our systems. We expect both riders and drivers to be honest, without trying to defraud the system.  

Discrimination 

Lynkup Taxi Services’ is committed to connecting riders with professional and reliable drivers so that we can take you to your desired destination. We will treat you with utmost respect and we expect that level of respect to be reciprocated. We have a zero-tolerance policy towards discrimination of any kind at Lynkup Taxi Services. At Lynkup Taxi services, we will not refuse you transportation based on race, color, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under relevant federal, state, or local law. Any driver who refuses to accept a rider based on their identities, can be permanently barred from using the app. We expect drivers using the Lynkup Taxi Services app to comply with all relevant state, federal and local laws governing the transportation of riders with or without disabilities, including transporting service animals.

Each time you ride with us, you should feel like you are on a mission that is safe and relaxed. Lynkup Taxi prohibits all riders and their guests, as well as driver and delivery partners, from carrying firearms of any kind while using our app. 

Violators of this policy may lose access to Lynkup taxi Service Inc. platform. 

 

GUIDELINES FOR LAW ENFORCEMENT

 

Legal 

Lynkup Taxi Guidelines for Law Enforcement Authorities - United States 

In keeping with the mandate of the organization and in conformity with applicable legal standards, we provide the following operational guidelines for law enforcement officials who are seeking information from Lynkup Taxi  Services, and its subsidiaries. From time to time, we may modify or change these guidelines without prior notice. We encourage Law enforcement officials operating outside the United States to consult Lynkup Taxi Services through our email for any further clarity. 

Periodically, law enforcement may find that a rider or one of our representative driver-partner who has filed a complaint may be able to directly provide the best evidence and information that is requested. We will attempt to offer you as much assistance as we can possibly provide. 

Who are we 

Lynkup Taxi Services is an innovative and technology driven company operating with a proprietary technology application software (the “App”) that provides on-demand lead generation and related services. Through this App independent providers of transportation services respond and comply with the requests from riders requesting transportation services, . These drivers provide transportation services to riders based on their requests, picking them up and dropping them off at the venues said riders entered through their rider apps. 

Business Information and Record keeping 

The organization is very strict on its document processing and storage policy. Information is stored on our servers and are therefore retrievable based on requests or as needed. This information includes receipts, commissions paid and are payable to drivers, trip details, etc.  When both drivers and riders signup to use our services, all data captured are stored and maintained on our servers. 

Records preservation  

If and when we receive any formal written request, we will offer our assistance in supplying and preserving any such requesting records that  may be in connection with official criminal investigations for 120 days. If  an extension is requested by law enforcement, we may extend such preservation request for an additional 60 to 90 days. After the expiration of the 90 days, such preserved documents will no longer be considered “preserved”. 

Legal Process Requirements 

It is our intention to provide responsive records in accordance with our company’s policies, and applicable law. Some general principles are set forth here, but may not apply in every case. 

We will not disclose any personal records without a subpoena that is directly issued in connection with an official and specific criminal investigation requiring any disclosure of basic information. A search warrant issued under the procedures described in the Federal Rules of Criminal Procedure or equivalent state warrant procedures upon a showing of probable cause is required to compel our disclosure of certain communications between people using Lynkup Taxi Services or GPS location information. There may be a few exceptions to these requirements that may be available in emergency or other crucially deemed circumstances, wherein a user has provided consent, or - for requests that do not require a warrant – in the place wherein other legal or regulatory standards are applicable. 

Emergency and Exigent Requests 

It is our duty to protect our riders and passengers and to keep them safe while they are in our care. Lynkup taxi has a due process for evaluating requests on an emergency or special case basis. If an emergency arises,  that involves protecting a rider, driver-partner, or third party who has been physically harmed or stopping illegal activity that poses an immediate threat of physical harm, or in cases of verifiable time-sensitive investigations, we can endeavor to allow the exercise of law to take its course, We want the requestors to send us an email immediately so that we can attend to such emergency expeditiously. .Lynkup Taxi Services, will do everything to assist with any investigations. 

Notice of Requests 

Lynkup Taxi Services’ policy is to notify riders and driver-partners of law enforcement requests for their information before we make any such disclosure, whenever possible, with exceptions for emergencies, exigent requests, when we have a good faith belief that notice would be counterproductive or would create a risk to safety, or when we are prohibited from doing so by law (i.e., by statutory prohibition or court order). If Lynkup Taxi Services receives a request for disclosure that is not governed by existing law or an accompanying non-disclosure order, we will give law enforcement the opportunity to seek court-ordered non-disclosure before we provide notice.  

 

NON-DISCRIMINATION

 

Lynkup Taxi Services Non-Discrimination Policy 

Lynkup Taxi Services mission is to provide and ensure that safe, reliable, and high-quality transportation options are available to everyone; without exception to anyone. Lynkup Taxi Services and its affiliates strongly disagree with any form of discrimination against riders or drivers based on race, religion, national origin, disability, sexual orientation, sex, marital status, gender identity, age or any other characteristic protected under applicable federal or state law. All discrimination is wrong, and Lynkup taxi Services does not endorse nor practice it. Any and all such discrimination includes, but is not limited to, refusing to provide or accept services based on any of these characteristics. In the event that any rider or driver is found to have violated this prohibition will lose access to the Lynkup Taxi Services platform. 

 

 

 

 

 

 

SERVICE ANIMALS

 

Policy regarding Service Animal  

Lynkup Taxi Services is determined to help the community in any way that we can. According to State and federal law, driver-partners using the Lynkup Taxi Services Driver App are prohibited from denying service to riders with service animals because of the service animals, and from otherwise discriminating against riders with service animals. It is not the company’s policy to discriminate in any way, form or fashion. Based on Lynkup Taxi Services’ Non-Discrimination Policy, driver-partners who engage in discriminatory conduct are in strict violation of this legal obligation will lose their privilege of the use of the Driver App. 

Our definition of a Service Animal 

A service animal is an animal that is trained to assist, work and or perform certain tasks for an individual with a disability. 

A driver is in breach of the law if he or she requests that the rider presents any or all documentation proving that the rider’s animal is a service animal. In compliance with the law, there are only two questions that a driver-partner may ask to confirm that a rider’s animal is a service animal: (1) Is the animal required because of a disability? And, (2) What work or task has the animal been trained to perform? The driver-partner may not request that the rider present documentation proving that the rider’s animal is a service animal. 

Legal Obligations of Driver-Partners 

Our drivers are legally obligated to provide service to riders with service animals. 

Furthermore, service cannot be denied to a rider with service animal due to allergies, dislike for animals, religious objections, or a fear of animals. 

As a part of our written policy, all driver-partners with Lynkup Taxi Services who use the Driver App have been made aware of their legal obligation to provide service to riders with service animals and have duly agreed to comply with the law. In the event that a driver-partner refuses to transport a rider with a service animal because of the service animal, said driver-partner has opted to violate the law and is also in breach of their agreement with Lynkup Taxi Services. 

What are the consequences for Refusal to Transport a Rider with a Service Animal? 

If Lynkup Taxi Services determines that a driver-partner knowingly refused to transport a rider with a service animal because of the service animal, the driver-partner will be prevented from using the Driver App after a thorough revision of the incident is conducted. 

In the event that Lynkup Taxi Services receives plausible and multiple complaints from riders that a particular driver-partner refused to transport a rider with a service animal, said driver will be permanently prevented from using the Driver App, regardless of the defense or justification offered by said driver. 

Reporting a Service Animal Complaint 

Once a rider submits a service animal complaint, Lynkup Taxi Services’ support team will investigate the issue and swiftly move to take appropriate action in order to rectify the issue. The support team will then make a reasonable effort to notify the rider within no later than a week of the outcome of the investigation and the actions taken.

Y our rights as a Rider with Service Animals 

No driver is legally authorized to refuse you to transport a rider because he or she travels with a service animal. All funds deducted from the rider for trip cancellation because of a service animal, will be duly refunded to said customer. 

Lynkup Taxi Services will make all attempts to contact and inform Riders of what action will be taken in response to their complaint about discrimination on the basis of a service animal, including whether or not Lynkup Taxi Services has terminated its contract with the driver-partner involved. 

 

SAFETY AND SECURITY

Data Sharing in Emergencies 

It is the intention of the management of Lynkup Taxi Services to keep all our drivers and riders safe. With that in mind, we are continuously endeavoring to make sure that riders and drivers have access to tools that help them stay safe whenever they employ the use of our services. As we continue to upgrade our apps and provide the tools needed, we intend to be able to dial 911 directly from the app. However, in the meantime, should you experience an emergency, situation, please don’t refrain from using your cellphone to do so.  

 

In order to protect you, Lynkup Taxi Services will retain your location and trip information as well as information about the times when you use our app. Lynkup Taxi Services may keep this information as long as permitted by law and following that the information will be deleted. Your safety is our concern, and we want you to know that you are important to us, not just your business. 

 

TERMS OF SERVICE- MODIFIED

 

Charges 

As a Rider, you understand that your request or use of our services may result in some charges to you.  These charges will include fares, platform fees and other applicable fees, tolls, and taxes that may be required by certain cities. Under this section, will include any tips you give to the driver via the app. Lynkup Taxi Services reserves the right and to modify (increase or decrease) its pricing. In the event that Lynkup Taxi Services determines that such modification is necessary, the company will make such announcement via its website so that all users will be duly notified. 

It is our intention to keep fares as low as we possibly can. There are two fare structures that we operate with: 

  • Variable Fares. Variable fares consist of a base charge and incremental charges based on the duration and distance of your ride. For particularly short rides, minimum fares may apply. Please note that we use GPS data from your Driver’s phone to calculate the distance traveled on your ride. We cannot guarantee the availability or accuracy of GPS data. If we lose signal we will calculate time and distance using available data from your ride. 
  • Quoted Fares. In some cases Lyft may quote you a Fare at the time of your request. The quote is subject to change until the ride request is confirmed. If during your ride you change your destination, make multiple stops, or attempt to abuse the Lyft Platform, we may cancel the fare quote and charge you a variable fare based on the time and distance of your ride. Lyft does not guarantee that the quoted fare price will be equal to a variable fare for the same ride. 

Fees and Other Charges. 

  • Service Fee. You will be charged a “Service Fee” for each ride.. 
  • Prime Time. At times of high demand for Services (“Prime Time”) you acknowledge that Charges may increase substantially. For all rides with a variable fare, we will use reasonable efforts to inform you of any Prime Time multipliers in effect at the time of your request. For quoted fares we may factor in the Prime Time multiplier into the quoted price of the ride. 
  • Cancellation Fee. After requesting a ride you may cancel it through the app, but note that in certain cases a cancellation fee may apply. You may also be charged if you fail to show up after requesting a ride.  
  • Damage Fee. If a Driver reports that you have materially damaged the Driver's vehicle, you agree to pay a “Damage Fee” of up to $250 depending on the extent of the damage (as determined by Lyft in its sole discretion), towards vehicle repair or cleaning. Lyft reserves the right (but is not obligated) to verify or otherwise require documentation of damages prior to processing the Damage Fee. 
  • Tolls. In some instances tolls (or return tolls) may apply to your ride. We do not guarantee that the amount charged by Lyft will match the toll charged to the Driver, if any. 
  • Other Charges. Other fee and surcharges may apply to your ride, including: actual or anticipated airport fees, state or local fees, event fees as determined by Lyft or its marketing partners, and processing fees for split payments. In addition, where required by law Lyft will collect applicable taxes. See your market’s Lyft Cities page for details on other Charges that may apply to your ride. 
  • Tips. Following a ride, you may elect to tip your Driver in cash or through the application. Any tips will be provided entirely to the applicable Driver. 

General. 

  • Facilitation of Charges. All Charges are facilitated through a third-party payment processing service (e.g., Stripe, Inc., or Braintree, a division of PayPal, Inc.). Lyft may replace its third-party payment processing services without notice to you. Charges shall only be made through the Lyft Platform. With the exception of tips, cash payments are strictly prohibited. Your payment of Charges to Lyft satisfies your payment obligation for your use of the Lyft Platform and Services. 
  • No Refunds. All Charges are non-refundable. This no-refund policy shall apply at all times regardless of your decision to terminate usage of the Lyft Platform, any disruption to the Lyft Platform or Services, or any other reason whatsoever. 
  • Coupons. You may receive coupons that you can apply toward payment of certain Charges upon completion of a Ride. Coupons are only valid for use on the Lyft Platform, and are not transferable or redeemable for cash except as required by law. Coupons cannot be combined, and if the cost of your ride exceeds the applicable credit or discount value we will charge your payment method on file for the outstanding cost of the Ride. For quoted or variable fares, Lyft may deduct the amount attributable to the Service Fee, Tolls, or Other Charges before application of the coupon. If you split payment for a Ride with another User, your coupon will only apply to your portion of the Charges. Additional restrictions on coupons may apply as communicated to you in a relevant promotion or by clicking on the relevant coupon within the Promotions section of the Lyft App. 
  • Credit Card Authorization. Upon addition of a new payment method or each ride request, Lyft may seek authorization of your selected payment method to verify the payment method, ensure the ride cost will be covered, and protect against unauthorized behavior. The authorization is not a charge, however, it may reduce your available credit by the authorization amount until your bank’s next processing cycle. Should the amount of our authorization exceed the total funds on deposit in your account, you may be subject to overdraft of NSF charges by the bank issuing your debit or prepaid card. We cannot be held responsible for these charges and are unable to assist you in recovering them from your issuing bank.  

USER GENERATED CONTENT POLICY

User Generated Content Policy 

The company, in its discretion, may permit you occasionally to submit, upload, publish or otherwise make available to Lynkup Taxi Services through our website portal, material that we may deem appropriate and beneficial to be published on our website. Such material may be textual, audio, and/or visual.  The content may also be informational, commentary or feedback related to our services, support requests, and or submission of entries for competitions and promotions ("User Content"). Similarly, Lynkup Taxi Services may, in the entity’s sole discretion, edit, remove, or disable any or all User Content for any reason, including if Lynkup Taxi Services reasonably determines that User Content is in violation of this Agreement. Lynkup Taxi Services nor its agents, does not assume any liability or responsibility for User Content, for removing it, or not removing it or other Content. Lynkup Taxi Services cannot be held liable for any content that may offend, embarrass, or evoke any negative emotions, as not all material is pre-screened before publication. Furthermore, Lynkup Taxi Services does not endorse or approve any User Content available on the Services. 

All user content provided by you or your agent, shall remain your property. Since you have provided such User Content to Lynkup Taxi Services, you thereby grant Lynkup Taxi Services a, worldwide, unrestricted, transferrable, irrevocable, royalty-free license, with the right to sublicense, to use, copy, modify, create derivative works of, distribute, and to use in any other way as Lynkup taxi Services deem necessary or applicable, without further notice to or consent from you, and without the requirement of payment to you or any other person or entity. 

Any and all such document submission to Lynkup Taxi Services, is an acknowledgement that you are in compliance with this written User User Content Policy. Furthermore, you represent and warrant that: (i) you either are the sole and exclusive owner of all User Content or you have all rights, licenses, consents and releases pertinent and necessary to grant Lynkup Taxi Services the license to the User Content as set forth above; and (ii) neither the User Content, nor your submission, uploading, publishing or otherwise making available of such User Content, nor Lynkup Taxi Services' use of the User Content as permitted herein constitute or imply an infringement, misappropriation or violation of a third party's intellectual property or proprietary rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation. 

Lynkup Taxi Services will post additional rules that apply to your conduct on those services. 

 

ZERO TOLERANCE

Zero Tolerance Policy 

Lynkup Taxi Services believes strongly in safety and professionalism. As a professional service entity, we do not tolerate the use of alcohol, or drugs by drivers and rider using the Lynkup app. If you believe your driver may be under the influence of drugs or alcohol, please ask the driver to terminate the ride immediately. 

Lynkup Taxi Services does not accept smoking in the vehicles while traveling. If a driver is smoking, you may ask him or her to discontinue and refrain from doing so. Similarly, riders should refrain from smoking while traveling with a Lynkup taxi Services driver. We have a no smoking policy, which is applicable to both drivers and riders.
